Dedication v. Acceptance

Road maintenance agreements are a huge hot button in real estate right now. Homeowners must understand that a seller/developer's dedication of a road to public use does NOT mean NCDOT accepts the responsibility to maintain the road. Roads may be maintained by the state, city, an HOA, or the individual homeowners. If a road is not publicly maintained and there is not written proof, it is privately maintained by default. Lenders these days will require a road maintenance agreement in this case. This is a BIG deal!
